Curious if anyone else noticed this, but I can't create a new tab (via menu, or shortcut key) when the directory I'm in is empty.
Also, I like the highlight active pane's titlebar feature. I suggest changing the default color of the highlight or of the folder link color. By default they are the same, which makes the link effectively dissapear when you mouse-over it (when this new option is enabled). I realize the link color can be changed in the registry, I just think that by default they should be different.

If you wanted to have an intentional restriction, it would have been that you need a folder to open onto.
It is clearly just a loose end that one can open a new tab in a folder with a zero byte file; but not an empty folder.
Please it on the list of loose ends to address when you need a break from more frustrating activity.
