It's rumoured that Rolls-Royce cars can never, ever break down. However, very occasionally, they do 'fail to proceed'. Similarly, in the extremely rare event of a starting problem, a Rolls-Royce could be said to have 'elected to remain stationary'.Nobody likes to be wrongly accused, but if xplorer² does something unexpected it is 100% the operator's fault and not a bug in xplorer².
As a reminder of my own humility (well, somebody around here's got to have some), I'll add:

See, being none too proud myself, I'm happy to admit that I had to, in all my innocence, look up Bayesian Epistemology just to figure out your obscure reference to statistical analysis. That's the trouble with sesquipedalian muggles like yourself, always hiding behind big words. 
If you can't warm to the idea of a little humility nibbling away at the edges of conceit, you could at least employ less obvious euphemisms, like how the workaday user of x2 may encounter, from time to time, a distinctly lackadaisical (or, on rare occasions, a uniquely flamboyant) response to his commands. While this doesn't absolutely indicate the presence of a bug, the user could be convinced that a good stiff brandy might help him to reevaluate his priorities, and come to see how it was his search parameters which may have caused the misunderstanding.
Or something like that.

I grant you that xplorer2 has many major flaws but nothing of the sort that will result in file loss

I see what you did there... a play on words - I guess "file-homicide" just doesn't have the same ring to it. But true, I'd have to agree that file-misplacement is indeed the leading cause of teeth-gnashing amongst 21-79 year olds, and is 100% user-error. Ages 80 and up are on their own, after regretfully burning their drivers-licenses as an honest act of self-immolation.
Which is the main reason I can't live without TeraCopy - it tracks all user-initiated file movement: Robust, Copy-Paste, Drag-&-Drop, and happily gives me a couple of weeks worth of painfully detailed copy/move job logs, which has saved my sorry arse many times (I blame my misbehaving left-mouse button).
The one thing (if there can be just one?) that does annoy me with x2's unhelpful behaviour is that the status-bar/info-bar's running count of "selected" objects doesn't register single-selections, it only kicks in when 2 or more things are selected, which often leads to deleting/moving more files than expected: I glance at the status-bar, it shows "239 item(s) 0 B" (which is a lie), and so I middle-click on something (I use single-click activation) and assume that's my lucky-lady. Inevitably, it turns out that x2's habit of "helpfully" pre-selecting the "last browsed" objects catches me out, and I have to look at the status-bar again and see that it now says "2:31.3 MB" - so I have to wonder who the other lucky-lady may be, as I don't remember selecting her.
No doubt I complained about this years ago, but was unable to make you see sense. And while this could technically be called "user-error" as I am responsible for making sure the info-bar doesn't say "2:..." before guillotining my women, would it kill you to register single selections? I mean that Anne Boleyn chick deserved it, but her bed-warming handmaiden was a real loss, and completely unintended.
This is neither a bug nor user-error, just unfortunate and illogical design - something I've made a career out of accusing you of.

Actually, this is curious: I just checked to see if this annoying behaviour is replicated using checkbox-selection, and it turns out it's not! Single-selection checkboxes result in a "1:..." display. Unfortunately checkbox-selection leads to a whole other form of evil (Frodo -> Mordor -> Lots of Whinging), so I'm not crazy about that solution.
Methinks there should be consistent behaviour across the realm, no?

Tell that to my site security officer and my manager when the SharePoint logs pointed to me as the reason an excel file was deleted and not copied as I USED to do using X2. I now DOWNLOAD from Sharepoint so X2 never gets a chance to muck up the SharePoint library directly.
X2 happily deleted the file with no warning, no confirmation. I may have pushed the button, but X2 fired the missile.

Since DELETE is (almost) forever, where was the confirmation? Sometimes I get a pop-up, other times files just vanish.
No consistency....

if your theory is correct it should be reproducible. Try working with a copy of a file and transfer it a few times and see if it gets lost or what
btw copying from/to "funny" locations like the one you are talking about uses windows explorer copy routines
